Terms of Service

These Terms of Service ("Terms") govern your use of the HLTH mobile application ("App") and related services ("Services") operated by HLTH ("we," "us," or "our"). The App is provided free of charge. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The Services (free app; purchase verification for device binding)
The App is free to download and use. It helps you connect a compatible wearable device, view health and activity metrics (such as heart rate, sleep, steps, blood oxygen, blood pressure estimates where supported, and workout summaries), set goals, and optionally sync selected data with Apple Health or cloud features you enable.
Binding or fully enabling a compatible bracelet with the App may require proof that you purchased the device from HLTH or an authorized channel we designate. You may be asked to enter an order number or similar purchase key ("Order Key") that we issued or recorded for your transaction. We process that information to verify eligibility, reduce unauthorized use, and protect our customers. You must not share, sell, or publish Order Keys except as we expressly allow.
2. Not Medical Advice
The App is for general wellness and informational purposes only. It is not a medical device and does not replace professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions about a medical condition. Never disregard professional medical advice because of something you read in the App. If you think you may have a medical emergency, call your local emergency number immediately.
3. Eligibility
You must be able to enter a binding contract in your jurisdiction and meet any minimum age we require for account creation (typically at least 13, or higher where local law requires). If you are under the age of majority, you may use the App only with the consent of a parent or guardian.
4. Account, Order Keys, and Security
You may need an account to use certain features. You agree to provide accurate information and to keep your credentials secure. You are responsible for activity under your account. Order Keys are personal to your purchase; do not use another person's key or attempt to circumvent verification. We may suspend or revoke access if we reasonably suspect fraud, resale of keys, or violation of these Terms. Notify us promptly at [email protected] if you suspect unauthorized access.
5. Device and Third-Party Services
The App may use Bluetooth to communicate with your band, location services when you use outdoor activity features (as described in system permission prompts), and Apple Health if you choose to enable read or write access. Your use of third-party hardware and platforms is also subject to their respective terms and policies.
6. Acceptable Use
You agree not to misuse the App—for example, not to attempt to reverse engineer the App except where applicable law permits; not to interfere with or disrupt the Services; not to use the App in violation of law; and not to access another user's data without authorization.
7. Intellectual Property
The App, its design, trademarks, and content (excluding your data and third-party materials) are owned by HLTH or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms.
8. Open-Source and Third-Party Components
Certain software included in the App is licensed under open-source licenses. Full license texts are maintained by the respective open-source projects; we may also publish a summary on our website from time to time.
9. Disclaimers
To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the maximum extent permitted by applicable law, HLTH and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the App. Because the App is offered free of charge, our aggregate liability for claims arising out of the Services is limited to fifty U.S. dollars (USD $50) unless applicable law requires a different minimum.
11. Indemnity
You agree to defend and indemnify HLTH and its affiliates, officers, and employees against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the App or violation of these Terms, to the extent permitted by law.
12. Suspension and Termination
We may suspend or terminate access to the Services if we reasonably believe you violated these Terms or if required for legal or security reasons. You may stop using the App at any time. Provisions that by their nature should survive termination (including Sections 2, 9, 10, and 13) will survive.
13. Changes
We may update these Terms from time to time. We will post the updated version in the App and update the "Last updated" date. Continued use after changes constitutes acceptance unless applicable law requires additional consent.
14. Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of the competent courts in the Kingdom of Saudi Arabia.

تحكم شروط الخدمة هذه («الشروط») في استخدامك لتطبيق HLTH للهاتف المحمول («التطبيق») والخدمات ذات الصلة («الخدمات») التي تديرها HLTH («نحن» أو «لنا» أو «خاصتنا»). يُقدَّم التطبيق مجانًا. بإنشاء حساب أو استخدام التطبيق، فإنك توافق على هذه الشروط. إذا لم توافق، فلا تستخدم التطبيق.
١. الخدمات (تطبيق مجاني؛ التحقق من الشراء لربط الجهاز)
يُقدَّم التطبيق للتنزيل والاستخدام دون رسوم. يساعدك على توصيل جهاز قابل للارتداء متوافق، وعرض مقاييس الصحة والنشاط (مثل معدل ضربات القلب، والنوم، والخطوات، وتشبع الأكسجين في الدم، وتقديرات ضغط الدم حيث يدعمها الجهاز، وملخصات التمارين)، وتحديد أهداف، واختياريًا مزامنة بيانات محددة مع «صحة Apple» أو ميزات سحابية تفعّلها.
قد يتطلب ربط سوار متوافق بالكامل مع التطبيق إثبات أنك اشتريت الجهاز من HLTH أو من قناة مصرح بها نحددها. قد نطلب منك إدخال رقم طلب أو مفتاح شراء مشابه («مفتاح الطلب») أصدرناه أو سجّلناه لمعاملتك. نعالج هذه المعلومات للتحقق من الأهلية، وتقليل الاستخدام غير المصرح به، وحماية عملائنا. يجب ألا تشارك أو تبيع أو تنشر مفاتيح الطلب إلا كما نسمح صراحةً.
٢. ليست استشارة طبية
التطبيق لأغراض العافية والمعلومات العامة فقط. ليس جهازًا طبيًا ولا يحل محل الاستشارة أو التشخيص أو العلاج الطبي المهني. اطلب دائمًا رأي مقدّم رعاية صحية مؤهل لأي أسئلة طبية. لا تتجاهل الاستشارة الطبية المهنية بسبب ما تقرأه في التطبيق. إذا ظننت أن لديك حالة طارئة، اتصل برقم الطوارئ المحلي فورًا.
٣. الأهلية
يجب أن تكون قادرًا على إبرام عقد ملزم في نطاق سلطتك القضائية وأن تبلغ أي حد أدنى للعمر نطلبه لإنشاء الحساب (عادة ١٣ عامًا على الأقل، أو أعلى حيث يقتضي القانون المحلي). إذا كنت دون سن الرشد، يجوز لك استخدام التطبيق بموافقة ولي أمر أو الوصي القانوني.
٤. الحساب ومفاتيح الطلب والأمان
قد تحتاج إلى حساب لاستخدام بعض الميزات. توافق على تقديم معلومات دقيقة والحفاظ على أمان بيانات اعتمادك. أنت مسؤول عن النشاط تحت حسابك. مفاتيح الطلب شخصية لشرائك؛ لا تستخدم مفتاح شخص آخر ولا تحاول التحايل على التحقق. قد نعلق أو نلغي الوصول إذا اشتبهنا بشكل معقول في الاحتيال أو إعادة بيع المفاتيح أو انتهاك هذه الشروط. أبلغنا فورًا على [email protected] إذا اشتبهت في وصول غير مصرح به.
٥. الجهاز والخدمات الخارجية
قد يستخدم التطبيق البلوتوث للتواصل مع سوارك، وخدمات الموقع عند استخدام ميزات الأنشطة في الهواء الطلق، و«صحة Apple» إذا اخترت تمكين القراءة أو الكتابة. يخضع استخدامك للعتاد والمنصات الخارجية أيضًا لشروط وسياساتها.
٦. الاستخدام المقبول
توافق على عدم إساءة استخدام التطبيق—على سبيل المثال عدم محاولة هندسته العكسية إلا حيث يسمح القانون المعمول به؛ وعدم التداخل في الخدمات أو تعطيلها؛ وعدم استخدام التطبيق بما يخالف القانون؛ وعدم الوصول إلى بيانات مستخدم آخر دون إذن.
٧. الملكية الفكرية
التطبيق وتصميمه وعلاماته التجارية ومحتواه (باستثناء بياناتك ومواد الطرف الثالث) مملوكة لـ HLTH أو مانحي التراخيص لنا. نمنحك ترخيصًا شخصيًا غير حصري غير قابل للتحويل يمكن إلغاؤه لاستخدام التطبيق وفق هذه الشروط.
٨. المكوّنات مفتوحة المصدر والطرف الثالث
قد يتضمن التطبيق برمجيات مرخصة بموجب تراخيص مفتوحة المصدر. النصوص الكاملة للتراخيص لدى مشاريع المصدر المفتوح المعنية؛ وقد ننشر ملخصًا على موقعنا الإلكتروني من وقت لآخر.
٩. إخلاء المسؤولية
إلى أقصى حد يسمح به القانون المعمول، تُقدَّم الخدمات «كما هي» و«حسب التوفر» دون ضمانات من أي نوع، صريحة أو ضمنية، بما في ذلك ضمانات القابلية للتسويق أو الملاءمة لغرض معين أو عدم الانتهاك. لا نضمن أن يكون التطبيق دون انقطاع أو خالٍ من الأخطاء أو العناصر الضارة.
١٠. حدود المسؤولية
إلى أقصى حد يسمح به القانون المعمول، لا تتحمل HLTH وموردوها المسؤولية عن أي أضرار غير مباشرة أو عرضية أو خاصة أو تبعية أو عقابية، أو عن فقدان أرباح أو بيانات أو حسن نية، ناشئة عن استخدامك للتطبيق أو مرتبطة به. وبما أن التطبيق يُقدَّم مجانًا، فإن إجمالي مسؤوليتنا عن المطالبات الناشئة عن الخدمات محدد بخمسين دولارًا أمريكيًا (٥٠ USD) ما لم يفرض القانون المعمول حدًا أدنى مختلفًا.
١١. التعويض
توافق على الدفاع عن HLTH والشركات التابعة لها والمسؤولين والموظفين وتعويضهم عن أي مطالبات أو أضرار أو خسائر أو نفقات (بما في ذلك أتعاب محام معقولة) ناشئة عن إساءة استخدامك للتطبيق أو انتهاكك لهذه الشروط، إلى الحد الذي يسمح به القانون.
١٢. التعليق والإنهاء
قد نعلق أو ننهي الوصول إلى الخدمات إذا اعتقدنا بشكل معقول أنك انتهكت هذه الشروط أو إذا اقتضى ذلك قانونيًا أو لأسباب أمنية. يمكنك التوقف عن استخدام التطبيق في أي وقت. تبقى الأحكام التي يقتضي طبيعتها البقاء بعد الإنهاء (بما في ذلك الأقسام ٢ و٩ و١٠ و١٣) سارية.
١٣. التغييرات
قد نحدّث هذه الشروط من وقت لآخر. سننشر النسخة المحدثة في التطبيق ونحدّث تاريخ «آخر تحديث». استمرار الاستخدام بعد التغييرات يعني الموافقة ما لم يفرض القانون المعمول خلاف ذلك.
١٤. القانون الحاكم
تخضع هذه الشروط لأنظمة المملكة العربية السعودية. تختص المحاكم المختصة في المملكة العربية السعودية بالفصل في أي نزاعات تنشأ عن هذه الشروط أو عن استخدامك للتطبيق.
